DUAL AGENCY
While the practice of dual agency is legal in Virginia, Century 21 Nachman advises its sales force to understand the conditions under which is not allowed. If the salesperson has a close long-term relationship with or is related to one of the parties, then the other party must be treated as a customer and only perform these acts that do not involve discretion or the exercise or the agents own judgement.
While some of our agents obtain the other parties written consent to be treated as an Unrepresented party, others prefer to refer them to another licensee in the office creating a designated agency situation.
Please remember that disputes arising from agency representation is our professions top legal concern. Do not hesitate to rely on your manager for guidance concerning any advice about any agency question you may have.
